Notwithstanding anything stating the contrary in these terms and conditions, M3 shall not be held liable in contract, tort (including, without limitation, negligence), or any representations arising out of or in connection with “Your” use of M3, and or M3 content and service including but not limited to (a) any economic losses (including, without limitation, loss of revenues, profits, contracts, data, business, or cost of substitute services); (b) warranties or other rights by any third party; and (c) Under no circumstances shall the M3 be liable to any user due to the user's misuse of the M3 content or services, nor shall the M3 be liable for any matter which is outside the reasonable control of M3.

IN THE EVENT THAT A COURT DETERMINES THAT M3 MAY NOT DISCLAIM THE DAMAGES SET FORTH ABOVE, “YOU” DO HEREBY AGREE THAT UNDER NO CIRCUMSTANCES SHALL M3 BE LIABLE TO “YOU” FOR ANY AMOUNT EXCEEDING ONE HUNDRED DOLLARS ($100.00).

Any notice to M3 required for, or permitted by the Terms contained herein shall be in writing and shall be delivered as follows with notice deemed given as indicated: (i) by overnight courier upon written verification of receipt, or (ii) by certified or registered mail, return receipt requested, upon verification of receipt. All notices to the M3 must be sent to the attention of the “M3 Lifestyle, LLC” (official owner of M3) Legal Department at the M3 Lifestyle, LLC Headquarters located at “M3 Lifestyle, LLC” 150 10th Street, Cresskill, NJ 07626 USA.

This Privacy Policy will be governed by, and construed in accordance with the laws of the State of New Jersey, without regard to conflict of law principles. Any dispute or claim arising out of or in connection with this Privacy Policy shall be adjudicated in Bergen County, New Jersey.

By registering with M3, logging-on to M3, and/or entering the M3 Website, you do hereby agree to all of the terms and conditions as described herein.

Should any discrepancies arise in any of the terms contained in this Privacy Policy and the M3 Website Disclaimer and Terms of Use Agreement, the terms contained in the M3 Website Disclaimer and Terms of Use Agreement will take precedence.
